Amendment to the Act on European Grouping of Territorial Cooperation

With effect from 1 January 2026, Act LXXV of 2014 on European Grouping of Territorial Cooperation has been amended. The background to the amendment is the review of the legislative framework governing Hungarian public authentic registers. As a result of a process involving several authorities, it became necessary to partially amend Section 7 of the above-mentioned Act. Following the amendment, the full, effective text of the section is as follows (changes are highlighted):

Section 7 (1) The Authority shall maintain an electronic register of European Groupings of Territorial Cooperation having their seat in Hungary (hereinafter: EGTC Register).
(2) The EGTC Register shall contain the following data:
a) the name and registered seat of the European Grouping of Territorial Cooperation;
b) the name and registered seat of the members participating in the European Grouping of Territorial Cooperation;
c) the objectives and tasks of the European Grouping of Territorial Cooperation;
d) the fact of the acquisition, modification or deletion of public benefit status, the number of the relevant decision and the date on which it becomes final;
e) the duration of the operation of the European Grouping of Territorial Cooperation;
f) the name and place of residence of the director of the European Grouping of Territorial Cooperation, and the manner in which the right of representation is exercised (individually or jointly);
g) the approved convention and statutes of the European Grouping of Territorial Cooperation, and the place of residence of its director;
h) the date of registration of the European Grouping of Territorial Cooperation, and the manner in which the director’s right of representation is exercised (individually or jointly);
i) the registration number and the approved convention and statutes of the European Grouping of Territorial Cooperation;
j) the date of registration and the commencement of the winding-up, insolvency or liquidation proceedings of the European Grouping of Territorial Cooperation;
k) the date of termination and the registration number of the European Grouping of Territorial Cooperation;
l) the commencement of the winding-up, insolvency or liquidation proceedings of the European Grouping of Territorial Cooperation;
m) the date of termination of the European Grouping of Territorial Cooperation.
(3) Any change in the data entered in the EGTC Register shall be reported to the Authority within thirty days of the change. The rules applicable to registration procedures shall be applied mutatis mutandis to the notification and to the entry of the change in the EGTC Register.
(4) The existing and deleted data contained in the EGTC Register, as well as the statutes and the convention, shall be public; the Authority shall publish them on its website in a manner accessible to anyone without restriction.
(5) The EGTC Register shall be publicly authentic, with the exception of the data specified in point g) of subsection (2).
(6) Where the data specified in points b) and f) of subsection (2) are also contained in another public and publicly authentic register established under a different legal act, and there is a discrepancy between the data, the latter register shall prevail.

The amendment was promulgated in Section 227(1) of Act LXXX of 2025 amending certain acts in connection with Act LXXXII of 2024 on public authenticity and the uniform management of public authentic registers, published in Hungarian Gazette No. 127/2025.
