CHALLENGES OF ESTABLISING AN EGTC IN THE TRIPLE BORDER AREA. THE CASE OF BANAT-TRIPLEX CONFINIUM EGTC
Abstract
The European Union created an opportunity for members to establish EGTCs, which are ‘bodies‘ with legal personality, in 2006 in order to facilitate the cooperation of national, local and regional actors and to enhance the efficient use of resources of the European Union.
The revision process of the EGTC Regulation (1082/2006/EC) gives an opportunity to examine the conditions for elaboration of development and codification propositions of EGTCs on the formation of Banat-Triplex Confinium with Hungary and Romania as full members, while Serbia as an observer member, and to give a new legal bases. The criteria for approval by national authorities are specified, a simplification of the procedures and a limited time for examination are proposed.
The Hungarian experience with establishing an EGTC shows that the three-month approval period by a Member State is rarely respected.
